1. About these terms

Welcome to GrowBox. In these terms, "we", "us" and "our" mean GrowBox Limited, and "you" means you, our customer. GrowBox operates this online store and is powered by Shopify.

These terms, together with our Privacy Policy, Refund Policy, Cancellation Policy and Shipping Policy, govern your use of our store and your purchases from us. By using our store or placing an order, you agree to these terms. If you don't agree with them, please don't use our store.

2. Who can shop with us

To buy from us you need to be at least 18 years old, or have the consent of a parent or guardian. By ordering, you confirm you meet this requirement.

3. Your account

You may be able to create an account with us. If you do, please keep your login details safe and let us know if you think someone else has accessed your account. You're responsible for activity that happens under your account.

4. Our products

Many of our products are living things, so the exact size, shape and appearance of what arrives may vary a little from the photos on our store. That's the nature of plants, and part of the fun. We do our best to describe and picture everything accurately, and we may update or discontinue products at any time.

5. Placing an order

When you place an order you're making an offer to buy. We'll confirm by email once we've accepted it. Occasionally we may need to decline or cancel an order (for example if a product is unavailable or there's been a pricing error) — if that happens we'll let you know and refund anything you've paid in full.

6. Prices and payment

Prices are shown in New Zealand dollars and include GST. The price you pay is the price shown at checkout and confirmed in your order email. Shipping is added at checkout where it applies. Prices and promotions can change, but changes won't affect an order we've already confirmed.

7. Shipping and delivery

How we ship, timeframes and costs are set out in our Shipping Policy. Because we arrange delivery for you, your order is our responsibility until it reaches you. If anything is late or arrives damaged, just contact us and we'll put it right — you never need to chase the courier yourself.

8. Returns, refunds and cancellations

We want you to love your GrowBox. If something isn't right, we'll do our best to fix it. Full details of how returns and refunds work for our living and perishable products are in our Refund Policy, and how to cancel an order or subscription is in our Cancellation Policy. These sit alongside your rights under New Zealand consumer law (see section 10).

9. GrowBox subscriptions

If you sign up to a GrowBox subscription, you agree to a recurring payment for each box until you pause or cancel. Subscriptions run at a monthly schedule, but this will always be clearly stated at checkout, in your profile and in some cases in your mobile app account. You can cancel anytime from your account or by emailing us, and we'll always confirm your cancellation.

10. Your rights under New Zealand consumer law

Nothing in these terms limits or excludes your rights under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or any other law that can't be excluded. When you buy from us as a consumer, our goods come with guarantees that cannot be contracted out of. If a product is faulty, not as described, or doesn't do what it should, you're entitled to a remedy under New Zealand law.

11. Our liability

To the extent the law allows, we're not liable for indirect or unexpected losses beyond our reasonable control. Nothing in this section reduces your consumer guarantees or any liability that can't legally be excluded. In short: your statutory rights always come first.

12. Intellectual property

Our store content — including text, images, graphics, logos and the GrowBox name — is owned by us or our licensors and protected by New Zealand and international law. You're welcome to use our store for your own personal, non-commercial use, but please don't copy, reproduce or resell our content without our written permission.

13. Acceptable use

Please use our store lawfully and fairly. Don't try to break, misuse or interfere with the store, upload anything harmful, or use it to harass others or infringe anyone's rights. We may suspend or close an account that breaches these terms.

14. Third-party links

Our store may link to other websites we don't control. We're not responsible for their content or practices, so please review their own terms and privacy policies before using them.

15. Our relationship with Shopify

GrowBox is powered by Shopify, which provides the technology behind our store. Your purchases, though, are made directly with GrowBox — Shopify isn't the seller and isn't responsible for our products or your orders. Any issue with an order is between you and us, and we're happy to help.

16. Privacy

We handle your personal information in line with the Privacy Act 2020, as described in our Privacy Policy. By using our store you acknowledge you've read it.

17. Changes to these terms

We may update these terms from time to time. The current version is always on this page, and we'll note the effective date at the top. Significant changes won't affect orders you've already placed.
